Mitch Winehouse has been forced to put the Amy Winehouse Foundation on hold.
The singer's father had planned to set up a charity for those struggling with addiction.
Unfortunately, a third party claimed the name of the foundation before Mitch had the chance to register it.
He said: "Somebody else pinched it off us before we could we could get it registered. All these donations which are coming in – we don't know what to do with them at the moment."
He was also forced to announce that he would be sending back cheque donations because he did not have a bank account in the name to which they were addressed.
According to Mitch, the individual who currently owns the name had the intention of selling it in an online auction.
He said in response: "Our solicitors are all over this, but it takes time. Meanwhile we can't get on with the foundation."
This news comes after the recent discovery of theft in Amy's former Camden home.
