Emile Hirsch charged with Sundance assault

Emile Hirsch has been charged with aggravated assault after allegedly choking a female film executive at the Sundance Film Festival last month. The 29-year-old actor Milk actor could face up to five years in jail if convicted of the offence.

The woman attacked by Emile has been identified at Dani Bernfeld, who works for Paramount Pictures.

According to court documents, she was approached by the actor at around 3.15am at Tao nightclub, Park City. He appeared intoxicated and asked why she looked "so tough" before calling her a "rich kid" who should not be at Sundance.

It is claimed that Emile then grabbed Ms Bernfeld before she pushed him away and he left the area with some friends.

Shortly afterwards he came up behind her, and wrapped his arms around her to put her in a chokehold, the documents state. He pulled her across a table and onto the floor, where he landed on top of her.

He then wrapped his hands around her neck. Ms Bernfeld said she felt as though "the front and back of her throat were touching", adding that she may have temporarily blacked out.

Two bystanders apparently pulled Emile away, and a witness has backed up Ms Bernfeld's version of events, the documents state.

The actor has also been charged with a misdemeanour count of intoxication. He is due to appear in court of 16 March.
